These terms apply to your use of this website and to any free property review you request through it. Please read them — particularly the parts about what we are not.
The three that matter most. We are not a law firm and this is not legal advice. We are not part of any court or government agency. And you are always free to claim surplus funds yourself, directly and at no charge.
1. Who we are, and what we are not
American Equity Recovery Group is a private company that helps former property owners and their heirs locate and claim unclaimed surplus funds arising from tax foreclosure and mortgage foreclosure sales.
- We are not a law firm and we do not provide legal, tax or financial advice. Nothing on this site is advice about your particular situation.
- We are not affiliated with any government body. We are not a county, a court, a clerk's office, a state unclaimed-property department, or any agency, and we do not act on their behalf or with their endorsement.
- Contacting us does not create an attorney-client relationship, because we are not attorneys. Where a claim requires legal representation, we will say so.
2. You can do this yourself
Surplus funds are a matter of public record. In most jurisdictions you may file a claim directly with the county or court holding the money, for free, without us and without anyone else. We will tell you where to start if that is what you would rather do. Our service is optional convenience and experience, not a requirement.
3. The free property review
When you send us a property, we search the public record and tell you what we find, including when we find nothing. The review is free and creates no obligation on either side. Sending us a property does not, by itself, engage us to act, and it does not oblige us to take on a claim.
4. Fees
We work on a contingency basis. There is no charge to check whether a surplus exists, nothing payable up front, and no bill if a claim does not come through. Where we do recover funds, our fee comes out of those funds.
The fee is set out in a separate written agreement, which you see and sign before anything is filed. Nothing on this website is that agreement, and nothing here sets a price. Several states cap what may lawfully be charged on these claims, and where a cap applies we work within it.
5. No guarantee of outcome
We do not promise that a surplus exists on your property, that a claim will succeed, or that funds will be released by any particular date. Many sales leave no surplus at all. Timelines are set by the court or the county, not by us, and competing claims can change both the outcome and how long it takes.
6. Deadlines
Every state sets its own window for filing a surplus claim, and those windows close. We will tell you the deadline we find for your property, but you remain responsible for your own claim and we cannot revive a deadline that has already passed.
7. Accuracy of what you tell us
Our work depends on the property details and documents you give us. If they are wrong or incomplete, the search and any claim built on it may be wrong too. Please tell us if anything changes.
8. The estimator on our home page
The sliders on the home page are an illustration of how a surplus is created. They are not a valuation, a quote, an offer, or a statement about any specific property, and the figure they produce has no bearing on what any real claim is worth.
9. The website itself
Content on this site is general information and may change without notice. We try to keep it accurate but do not warrant that it is complete or current. The site is provided as is. To the fullest extent the law allows, we are not liable for indirect or consequential loss arising from your use of the site.

10. Contacting you
If you submit the form and tick the consent box, you agree we may contact you about that property by phone, text or email. You can withdraw that at any time. See our Privacy Policy for what we do with what you send us.
11. Governing law
Surplus funds are created and released under the law of the state and the county where the property was sold, and those statutes differ substantially from one place to another. Deadlines, who may file, what documents are required and what may lawfully be charged are all set locally. Nothing in these terms overrides the rules of the jurisdiction holding your funds.
12. Changes to these terms
If these terms change, the updated version is posted here with a new date at the top. Continuing to use the site after that means the new version applies.
